By downloading, installing, or using the Contra Calor application or website (collectively, "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
The Service is operated by Sybrand van Zyl ("I," "me," or "my"). These Terms constitute a binding agreement between you and Sybrand van Zyl.
Contra Calor is a viticulture Growing Degree Day (GDD) tracking application that provides historical GDD accumulation data, Winkler scale classification, and vintage comparison tools to assist vineyard managers and wine industry professionals with phenological tracking and harvest planning.
GDD calculations are powered by the Visual Crossing Weather API using station-priority historical temperature data. Results are stored locally on your device as vineyard profiles with nested vintage records.

Pro subscription pricing is displayed within the App and on our website. Prices are subject to change with reasonable notice. Your subscription will be billed through Apple App Store according to their billing terms.
You may cancel your Pro subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. Refunds are governed by Apple App Store policies.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
The Contra Calor name, logo, app design, and all associated content are the intellectual property of Sybrand van Zyl. All rights reserved. Nothing in these Terms grants you any right to use our trademarks, trade names, or branding.
GDD data provided by Contra Calor is derived from the Visual Crossing Weather API using station-priority historical temperature data. Results are subject to the limitations described in our Data Accuracy Disclaimer.
The Service is a decision-support tool and is not a substitute for certified meteorological data, on-site weather stations, or professional agronomic advice. We do not warrant that the data will be accurate, complete, timely, or suitable for any particular agricultural decision.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SYBRAND VAN ZYL DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SYBRAND VAN ZYL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF HARVEST, AGRICULTURAL LOSSES, DATA LOSS, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for any claim arising out of or related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
The Service integrates with third-party services including Visual Crossing (weather data), Mapbox (maps), RevenueCat (subscriptions), and Apple App Store (payment processing). Your use of those services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of any third-party services.
We reserve the right to terminate or suspend your access to the Service at any time, for any reason, with or without notice. Upon termination, your right to use the Service ceases immediately.
You may stop using the Service at any time by uninstalling the App.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Napa County, California.
We may update these Terms from time to time. The current version will always be available at contracalor.com/terms. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
